Legislative Innovations?

I had a post all cued up to go...
And then I had to revise it. See, I almost made the mistake of assuming I knew what political side someone was on from a few things they wrote. Yea, I know. Silly huh?
 
The person in question isn't someone I read every day. I'm sure that if I did, I would understand her positions a little better. Unfortunately, The Atlantic isn't one of my main coffee table sites. Maybe it should be.
 
The reason I'm even blathering on about this is Little Miss Attila. It's all her fault. She's the reason I was shoved into the world of hyper-realism and ultra-awareness. I'm sure that if only a redneck like myself could, but for a little while, take off my boots and blue jeans and wade through the streets of New York or Philadelphia or San Francisco, I'd gather by sheer osmosis, the wisdom of some more learned authors. (Sorry about that visual)
 

I'm going to be in hot water for this, but I have to question Megan McArdle's use of some terminology in one of the articles I read today. Forgive me if I've gone off the deep end here. Please, let me know if I'm being overly critical.

Being a lowly robot in the food-chain of the blogosphere, I usually refrain from critique of someone in the journalism field. After all, they are paid for their verbiage.
 
Today, however is not one of those days. Call me wreckless. (HT Michelle Malkin and the Dem's for the new spelling.)

Ms. McArdle posted an interesting piece at The Atlantic on the tyranny of the majority and cautioning against too much gloating over the health care victory. She even went so far as to recognize the inherent danger in ignoring the will of the American people. Something I agree with by the way. What she cautioned against was expressed in this phrasing:
If the GOP takes the legislative innovations of the Democrats and decides to use them, please don't complain that it's not fair.  Someone could get seriously hurt, laughing that hard.

But I hope they don't.  What I hope is that the Democrats take a beating at the ballot box and rethink their contempt for those mouth-breathing illiterates in the electorate... 
Legislative innovations? I guess if you would define unconstitutional procedures, bribery, deceit, arm twisting and I'll venture a guess at blackmail as legislative innovations then you might want to take out some stock in the next printing of Webster's because everyone in the country is going to need a copy to decipher the new language.

I have to ask, am I reading this correctly? Do I understand Ms. McArdle to mean that she would actually justify or could justify the use of such tactics? Because that is the way it seems. Granted, she has left herself an "out" here by the little "I hope they don't" line. But the suggestion has been made.
 
Look, I know we are in the middle of a fight right now and tempers will flare, but to condone such procedures for one's own side is to give them the thumbs up for all sides. To threaten to use them in the future because they have been used in the past is patently wrong; not to mention that it would just embolden the opposition and add credence to their very use in the first place.

If we threaten to use these measures in the future, what possible criticism can we use against the process and resulting legislation that came from it? I'm sorry, I don't see the logic.

If these new legislative innovations, as McArdle calls them, are given the seal of approval, then we are just as bad as what we are fighting. We should take the high road on this issue, even if it means losing, because to do otherwise is to become what we despise.

I'm sorry for going off here, Ms. McArdle but I believe you are wrong to encourage or even mention this tack as legitimate. If I have read you incorrectly, please, enlighten me.

It is my not so humble opinion that this war can still be won. That the legislation itself is unconstitutional is the ground of the battlefield.

As I write this I'm listening to the AG of Texas on the radio give the basis of a lawsuit about to be filed opposing Obamacare. The main points being that the Federal Government is not allowed and is in fact prohibited by the Constitution from requiring a citizen to purchase a product or service. Let's fight the fight with the Constitution in hand and not get distracted by the "well you did it" mantra.

If we wish our leaders to be righteous and fair then we must require it from them, not encourage bad behavior on our own side as tit for tat. It would only play into the oppositions hands.

As to the gloating, to Obama, Ried and Pelosi I say gloat. Go ahead. Get it out of your system. All you will accomplish is enraging an already angry TEA Party and waking up a sleeping elephant.

In reality, the first part of M.M's article that stuck me in the eye was this quote:
One cannot help but admire Nancy Pelosi's skill as a legislator.  But it's also pretty worrying.  Are we now in a world where there is absolutely no recourse to the tyranny of the majority?  Republicans and other opponents of the bill did their job on this; they persuaded the country that they didn't want this bill.  And that mattered basically not at all.  If you don't find that terrifying, let me suggest that you are a Democrat who has not yet contemplated what Republicans might do under similar circumstances.  Farewell, Social Security!  Au revoir, Medicare!  The reason entitlements are hard to repeal is that the Republicans care about getting re-elected.
My comment at LMA's place was:
"Farewell, social security! Au revoir, Medicare! The reason entitlements are hard to repeal is that the Republicans care about getting re-elected."
I think it might actually be a badge of honor and help get them re-elected.
Anyone brave enough to stand against entitlement mentality gets my vote. I would also bet that a large number of newly awakened Americans agree with me. Optimism. Yea, it’s my curse.
Side note: Saw Instapundit mention you today, AGAIN. Hows that Instalache workin out for ya? Traffic envy is petty, but it’s mine.

On reflection, I have to also question any "admiration" for "Nancy Pelosi's skill as a legislator". I could do a freaking hell of a lot with a stimulus package full of voters' money to bribe a bunch of crooked legislators with. The fact that it took so long and so much money is a testament to the TEA Party and the common every day citizens who manned the phones day after day and trekked to DC trying to stop this garbage. The fact is, they scared the hell out of those lawmaker/breakers and caused a more lengthy process.

Are you beginning to understand why I was having trouble figuring out which side M.M. is on?  I sincerely hope I'm missing the sarcasm. Surely, I am. Again, I apologize if I'm being overly critical, but to admire Pelosi is, to me, to admire a mobster for his murder and thievery techniques or Satan himself for his prowess at deceit.

I might be an optimist, but as of Sunday night, I'm an optimist with a grudge.

The man who sold Massachusetts Government health care now disses it. For once, I agree with Mitt Romney.

Reclaiming the American Spirit

The War of Independence was over, the Constitution ratified, and America's first President was about to set a precedent.

He could have established a monarchy with his charisma and the fact that no provision was in place for the President's term of service. The people and the Congress as a whole loved him that much. But as was his way, he lead by example; he set down the scepter of power and passed the torch of freedom and guardianship of the Constitution to the trust of God and the next elected caretaker of America's Constitution.

This was the setting when George Washington, after presiding over the birth of a nation unlike any ever before conceived, addressed the State Governments in his Circular Letter of 1783, his last before he retired from public service. He wrote in part,

"The Citizens of America, placed in the most enviable condition, as the sole Lords and Proprietors of a vast Tract of Continent, comprehending all the various soils and climates of the World, and abounding with all the necessaries and conveniences of life, are now by the late satisfactory pacification, acknowledged to be possessed of absolute freedom and Independency; They are, from this period, to be considered as Actors on a most conspicuous Theater, which seems to be peculiarly designated by Providence for the display of human greatness and felicity."
Then, speaking of the age soon to be termed The Enlightenment he continued,
"The foundation of our empire was not laid in the gloomy age of Ignorance and Suspicion, but at an Epoch when the rights of mankind were better understood and more clearly defined than at any former period."
And in another passage he said, 
"At this auspicious period, the United States came into existence as a Nation, and if their Citizens should not be completely free and happy, the fault will be entirely their own." (as quoted in Founding Brothers ~ Joseph J. Ellis)

Looking at America during my short life time and studying our history, I have to ask, are these the words of a President, a psychic, a fortune teller or all the above?

People of America, our country is in peril! We are in a fight for the very soul of our nation. Barack Obama and his minions are poised to destroy our Constitution and are setting into motion the tools and machines that will be the ruination of our way of life and prosperity.

We are descended from the same people George Washington spoke of as "designated by Providence for the display of human greatness". We are the descendants of heroes that defeated totalitarians like Hitler and helped free the European continent twice!

Have we become so arrogant and selfish that we allow a tin horn wanna-be dictator to come in using charismatic smoke and mirror, class envy tactics, relying on the the good will of the people, and feeding off the guilt of our past to tear down the very fabric of this nation?

This is not just wrong. What the progressives in DC are doing is evil, plain and simple. It is a reintroduction of slavery to the only country in the world that has ever abolished it.

Obama claims to be another Lincoln. He is not. He is in fact the antithesis of Lincoln. The Anti-Lincoln, in terms of freeing the slaves because he would enslave every hard working soul in America to achieve his goal of domination over them in the guise of equality and reparations. Redistribution of wealth is nothing less than a road to communism and a totalitarian state.

How is it that a man can go to college in this country, profess to learn Constitutional Law and not love the very thing that he swore an oath to uphold?

Who better to destroy the constitution but a supposed expert of it?

People, make no mistake, this is no small battle, it is a war for the soul of our nation. Look at the every day Americans who show up at town halls and march on Washington time after time in opposition to the sheer lust for power and control in our halls of law and justice. Those halls were built to proclaim and promote liberty and freedom, not to spread tyranny and fear and the people who march are to be commended because they speak for the millions of us who cannot go. To them I say Thank You.

In the course of our history, Americans have bonded and banded together against their common foes. Why is it that now we are so divided? Why is it that some of us are too selfish to see that they are projecting their own selfishness onto others?

It is time once again for Americans to recognize a common enemy and combine our strengths to defeat it.

Years ago, a friend of mine who held three black belts, had a quote on his vanity mirror. It read, "We have met the enemy, and he is us." This is closer to the truth than you think, for it is our own greed that will destroy us. If we would live off the fruits of others' labors then we are doomed to fail. If we would listen to a man that tells us that the cure for problems caused by the Government is more Government, then we are selfish and stupid and are doomed to fail.

Think of your Grandparents and Great Grandparents and the trials they endured in the Civil War, the Dust bowl, the Great Depression and two World Wars in order for us to be here in this time. Is this is how we honor their spirit?

I believe that America is better than this current crop of leadership.

It is time for Americans to once again show that we love our country more than ourselves.

And it's time the politicians did the same, or got the hell out of our Halls of Congress and the White House.

God Bless America and the spirit of her founding.

I've been trying to call Rep. Stupak, Sorry to say his voicemail is full. So I went to congress.org, found his website and sent an email. I'm outside his district and the site says that he can't reply to me. I wonder if the email went through. Anyway, here is what I sent.

Representative Stupak, Sir please oppose the Health Care Bill as it stands. I think you and I both know that it funds abortion and is also an unconstitutional one. If it is such a benefit, then why have key votes been bought with bribes and arm twisting? Americans can do better for our country and each other.

Breaking (The Bank): Kucinich to Vote Yes on Health Care

Dennis Kucinich today flip-flopped his no vote on Health Care Reform. Changing a No to a trembling Yes, he announced the decision in what can only be described as a strange, disjointed news conference at the base of the passenger stair this morning after being taken for a ride in Air Force One.

The President, First lady and several unidentified, purple shirted attendants, went for a  2 to 3 hour grueling flight aboard the Presidents jet where the congress-critter was forced to watch home movies of Obama's wedding to Michelle and their recent vacation trip to Hawaii. The final straw, as told by anonymous sources, was when Michelle brought in some fresh baked cookies she had prepared especially for the arm twisting trip sight-seeing tour. At last, Kucinich finally succumbed to the overpowering pressure brought o bear.

"I just couldn?t take it anymore. I'm sorry America, but you weren't on that plane. You just don?t know! You weren't on that plane!" Kucinich was heard screaming as he, struggling, was led down the stairway.

Broken, obviously shaken and in shock by the ordeal, Kucinich was carried away by paramilitary paramedic personnel, presumably to an undisclosed hospital for mental evaluation and treatment.

Regrettably for Kucinich, Obama-Care has apparently found its first victem patient.

Clash of the Titan Conservatives

The Conservative Blogger Debates continue, with Motor City Times and The Classic Liberal acting as moderators and the combatants or sparring partners being Don at Present Discontent and Conservative Hideout vs. Scratcher at Makes My Brain Itch.

Be sure to read the fine points espoused on both sides of the question: "What should the focus of Conservatives be going forward, a revitalized Republican party or a true Conservative party?"

Now that the dust has settled from the first two debates, I would like to reference a comment made on the sidelines that I personally think was spot on and begs to be on a front page somewhere. Why not mine? It was made by darcprynce who resides over at The Daley Gator. His comment was on the CBD Palin Edition concerning what a difference her policies may have had if implemented as opposed to Obama's. He said:


"...what impact, if any, do you think Sarah Palin’s prior actions as governor or policy pronouncements more recently, would have on any given specific economic indicator or the economy in general?"
You mean if she'd been elected President instead of Odipshit?
Uh... well, she likely wouldn't have signed off on a massive, pork-laden "stimulus" bill, so average people wouldn't be hesitant to spend their money for fear of losing everything they own down the road, when Obamaflation roars over us like a tidal wave from some 1970s disaster movie.
She wouldn't have spent a year frightening everyone with endless talk of socializing the health care industry, so businesses would be hiring people in expectation of a future America which doesn't so closely resemble Castro's Cuba.
She wouldn't be threatening to raise every conceivable tax over the next few years, so company owners would be able to make reasonable business plans without fear of their elected representatives bashing them in the teeth at every turn for daring to be successful.
Nobody would be concerned with the possibility of her selling out our sovereignty to a bunch of Marxist assholes at the UN, so people who might be considering shooting themselves or someone else over that sort of crap would probably mellow out and concentrate on earning a living.
Cap & Trade legislation would be off the table, so the energy industry wouldn't be shitting its pants waiting for the next federal shoe to drop, and might actually begin to expand production for the first time since I was in grade school.
And who knows, maybe Mrs. Palin would have the basic common sense to... oh, I don't know... not bail out huge failing corporations like GM, thus strangling the corrupt, mafia-run unions that have helped run them into the ground, instead of rewarding the pricks and incentivising them to remain the royal fuck-ups they are indefinitely.
Of course, I could be wrong.
My response to this was: "@DarcPrynce Bravo! Well said. I think you hit the heart of the situation we are in, or at least close to it. It is a crisis of confidence. The people and business owners don't want to risk capital in the current climate..."
